Consumer - Bareroot Conditions of Sales & Supply

1. Availability / Ordering / Pick up

1. Ornamental trees are offered in (M) MEDIUM or (L) LARGE. 
2. Fruiting trees are available in one size only. 
3. Orders are offered as single tree or in multiples of 5 as a bundle. Options are priced accordingly.
4. Speciality Trees will make best efforts to supply all trees as quoted and will provide confirmation of your order accordingly.
5. In accordance with Speciality Trees’ bareroot tree production schedule, we seek to make trees available for supply between June and August each year.
6. Speciality Trees will notify when material is available for pickup at your nominated location.
7. If pictorial labels are requested, label quantity will reflect the quantity of the order or less as nominated and are subject to availability.

2. Payment Terms

1. All goods remain the property of Speciality Trees Pty Ltd until paid for in full.
2. Unless otherwise agreed in writing, payment will be required upon confirmation of the order.
3. Payment by direct debit and credit card is available and can be arranged by calling 03 9554 2000 quoting your invoice number.

3. Material Guarantee

1. Speciality Trees guarantee that all tree stock supplied will be true to type and in a sound and healthy condition at the time of supply.  Any claims to the contrary must be lodged with Speciality Trees within 3 days of receipt of stock. No liability is accepted in excess of the purchase price paid.  
2. No guarantee is provided for the future performance of our bareroot trees once this material has been supplied or planted.

Availability / Ordering

2. Delivery Charges and Conditions

1. If you request delivery, a delivery fee will be charged based on your location once the order is ready to be despatched. If you have any questions about this process, please contact us on 03 9554 2000. 
2. Delivery charges are based on the delivery destination ex nursery and the number and size of trees being delivered. Please discuss your requirements with sales staff when placing your order. 
3. Interstate deliveries can be arranged, and all costs on-charged accordingly. All interstate deliveries are subject to current DPI specifications and requirements for the transport of green life.
4. Speciality Trees is not liable for the late delivery of bareroot orders given the length of the ordering and supply process. We endeavour to ensure the order is supplied as per confirmation and that all changes to the order be communicated to the purchaser before despatch occurs. 
5. The purchaser accepts delivery to the designated address given at order confirmation or can pick up the trees at one of our two nursery sites as provided on the order confirmation. 
6. The purchaser has no right to refuse the material ordered unless cancellation of the order has been received by Speciality Trees prior to the 1st May in the year of supply. 
7. Speciality Trees will endeavour to remind customers of orders due for delivery and/or pickup.
8. Any shortage or damage to trees in transit must be drawn to the attention of the carrier at the time of delivery.

3. Payment Terms

1. All goods remain the property of Speciality Trees Pty Ltd until paid for in full.
2. Unless otherwise agreed in writing, payment in full is due on or before supply (at the time of pick up). 
3. Payment by direct debit and credit card is available and can be arranged over the phone. 

4. Material Guarantee

1. Speciality Trees guarantee that all tree stock supplied will be true to type and in a sound and healthy condition at the time of supply.  Any claims to the contrary must be lodged with Speciality Trees within 3 days of receipt of stock. No liability is accepted in excess of the purchase price paid.    
2. No guarantee is provided for the future performance of our bareroot trees once this material has been supplied, potted up for sale or planted.
